The office of the
Clerk of the Circuit Court has the responsibility of receiving and filing all
civil, probate, criminal, juvenile and traffic cases. This is the only source
through which they can reach the courts for trial. The Clerk collects all child
support, traffic and criminal case payments. The Clerk issues all processes such
as citations, notices and summons for service to the Sheriff and subpoenas all
witnesses in trials of all matters. A Clerk must be present at all court
sessions to swear in witnesses and write minutes on each case.
All pleadings,
petitions, complaints, answers, motions and judgments filed are recorded. The
filing fee collected by this office for each case entered of record is turned
over to the county's general fund for use in supporting this and other county
offices. This fee constitutes only one part of the money collected by this
office for distribution to various municipalities and other county offices. The
Clerk or Deputy Clerk draws and summons jurors. This office is a part of the
Sixteenth Judicial Circuit which includes DeKalb, Kane and Kendall Counties and
is located in the Courthouse. Office hours are 8:30 a.m. to 4:30 p.m., Monday
through Friday. Closed on all Court
Holidays.
